Does this also include episodes dated after '62 of programs that began before 1962? Godfrey, Breakfast Club and Paul Harvey come to mind.

And the Green Hornet. Both the Lone Ranger and Green Hornet were owned by George W. Trendle he sold the rights to Wrather Corp who then sold them to Disney. And who wants to go up against Disney?

Let's err on the side of caution for now on these two. It seems that I remember one of them as being copyright protected but I can't remember which one. I'm sorry I can't be more precise. We lost our comprehensive list, when the server crashed on the old site.

I'm right there with you, Space. Sergeant Preston was a Trendle production, which was also known as *Challenge*. I was going to suggest adding it, but james beat me to it.

Maybe this is a tricky question:

Jazz/Big Band - Radio Programs

Work for hire or Music Copyright or go ahead and post them?

In most cases because these shows are remotes, in the past we've allowed *Jubilee* and other such shows free reign. Check the thread already in existence, "Jump Jivin' Whale Room Rides Again" [You must be registered and logged in to see this link.] as that's where we've traditionally posted such shows.

Another thing which I remember from the old site was nothing by the BBC could be posted - except news reports from World War 2 were acceptable.  Alas, I don't remember why those had an exception, but I'm glad they did.

gathol, you are correct. Though I don't remember the WWII news exception. And I can't believe that it took someone this long to remember. Let's play it safe for now and ban everything Beeb for now. But I'm open to discussion on the news shows.

It surprises me that Family Theater is on this list. Who is upholding the copyrights on that?

It came as a surprise to several OTR share sites in the early to mid 2000's too. They were taken down by legal action for offering the shows for free download. I'm depending on a very fuzzy memory and could be wrong, but I believe Family Theater belongs to Conde Nast. While I can't recall the specifics of the event, I do remember the series' involved at the time. Primarily three series were very actively copyright enforced. Family Theater, The Green Hornet and The Lone Ranger.

Everything else on the list was also actively copyright enforced within the same general time frame. And some of them have been again, in just the past few years. I hate to sound preachy to our members, but it's very simple here at The Cobalt Club. We respect copyright and intellectual rights owners rights. And we always err on the side of caution.

I'm currently researching what could be an addition to the copyright rule. If I find that my information is correct, there will be an announcement in the near future. It concerns directing or linking to "Pirate" sites. This isn't a problem here, but we may need to include it to the rules "just in case".

Shows Which May Not Be Posted Due to Copyright Empty Re: Shows Which May Not Be Posted Due to Copyright

Post by ghemrats 3/25/2022, 12:51 am

As is customary, Space is right on target.

*Family Theater* and its owners were particularly litigious when the old Cobalt Club was active. For a time we were totally unaware of the copyright for the show and were posting it freely. When the old site went down and Space, in his infinite wisdom and tenacity, scouted out and created this "Annex," we brought a wealth of knowledge on copyrighting along for good measure. A great many of us vets followed joyfully.

As some of you vets will recall, the REALLY old Cobalt started out posting *Doc Savage* and *The Shadow* shows. Life was simple and good, and lovely sounds were enjoyed by all.

Then slowly, through the years, following the cash cow legal sensitivity of The Mouse who clamped down with a vengeance on personal holdings (remember the 1989 Oscar debacle when Rob Lowe danced with Snow White while singing "Proud Mary," and Ditzknee executives went ape-excrement and sued?)--OTR show advocates were struck with cease and desist orders from Street and Smith, Trendle Productions and others. Seamus and the Powers That Be wisely determined to beat the rising tide and just make Cobalt a haven for the non-threatening public domain. Hence the 1962 cut-off date as well.

*Family Theater*, created by Holy Cross Priest Patrick Peyton as part of a local Rosary prayer program in Albany, NY, was taken over by Holy Cross Family Ministries, sponsored by the Congregation of Holy Cross at Peyton's death in 1991. While many stations are licensed to play rebroadcasts of the show (Internet Archive and EWTN are among those), it's verboten at the Cobalt due to licensure and copyright laws. I can't tell you what year this was imposed, but I recall having downloaded the whole series literally JUST before the axe fell.

Anyway, I'm sure some others have more info than I, but these are my own ruminations. Take them for what they are--the ramblings of
an steadfast old timer from the days of *Doc* and *Lamont*.

Peace and prosperity, and long live Cobaltia.
Jeff

Shows Which May Not Be Posted Due to Copyright Empty Copyright Inquiry

Post by Connor12 1/14/2024, 10:35 am

Are shows like CBS Radio Mystery Theater, Zero Hour and The Creaking Door now considered Public Domain, since they have all passed the 50 year point?

In a word, no. The 50 year rule hasn't been considered the standard for many years. Consider that the Steamboat Willie image of Mickey Mouse just entered public domain.
Here at The Cobalt Club, we will continue to use the 1962 cutoff as our standard. As well as those series listed above.
